When an individual is injured in an accident, they may want to bring a lawsuit against the other side to recover damages. Compensation for injuries can make the entire process a lot easier on a person. The common concerns people have after being injured in an accident are regarding their increasing medical bills, the cost of rehabilitation, and lost wages because they can’t work. This concern grows when the individual who has been injured and wants to seek damages but also had a level of fault in causing the accident.

Depending on your situation, you may still be able to sue for damages if an accident was partially your fault. In order to determine if this is possible, an investigation may have to be conducted into exactly what happened to cause the accident. Witnesses to the accident will need to be interviewed and both sides may have to recount their stories truthfully in great detail. Experts may need to come forward and testify regarding their findings of their own investigation of the accident as well.

If these investigations show that you were at fault, but you were less than 50-percent at fault in causing the accident to occur, you may still bring a lawsuit to sue for damages. However, if the investigations reveal that you were 50-percent or more at fault in causing the accident,  you will not be able to bring a lawsuit suing the other side for damages.
