In December 2017, New York signed new legislation that aims to hold drunk drivers accountable for their actions. The new law states that any time a serious motor vehicle accident takes place, the driver that caused the accident will have to submit to a test that will determine whether they were driving under the influence of drugs or alcohol. A serious motor vehicle accident can be defined by one that causes one or more parties to become seriously injured or even suffer fatal consequences as a direct result of the crash. The new law will go into effect in the middle of January so it is important that residents of New York State make themselves aware of these changes.

Initially, the law stated that the driver only had to take a blood alcohol content test if there was probable cause that they were driving under the influence. However, with the updates to the law, police who arrive at the scene of the accident have a responsibility to give a blood, breath, or urine test to the driver involved in an accident to determine whether they were driving drunk. If the driver refuses to submit to a blood alcohol content test, they will be subject to an immediate license suspension.
