When you have been injured in a workplace accident, it is important to know that these accidents are not treated in the same way as a regular injury such as one sustained in a car accident. Upon being injured, it is important that you immediately seek medical attention and tell your supervisor who is working with you at the time of the accident. It is important that in addition to notifying your supervisor, you also tell your employer about your injuries in writing, detailing how you were injured and when the accident took place. This should be done within 30 days of the injury.

Your employer should report your injury to the Board of Workers’ Compensation as well as their own insurance company within 10 days of the date on which you notified them of your accident. Your next steps should be to file a workers’ compensation claim within 2 years from the date in which the accident occurred. Of course, it is always best to file your claim as soon as possible. Once your employer’s insurance company has been made aware of your injury, they should inform you of your rights (in writing) within 14 days of the date that they were notified.

If your employer fails to notify your insurance company that you have been injured in a work-related accident, you should notify the Board of Workers’ Compensation that they failed to assist you.
