Quite often I’m asked by clients, “Is my case going to have to go trial? Am I going to have to go into court? Am I going to have to raise my hand and swear to tell the truth in front of a jury?” Most cases in New York do not go to trial. They are able to be resolved before getting to the trial stage either by a settlement or by mediation or arbitration, and there are many different options that we have. Many people do not want to go to court if they absolutely do not have to go and therefore, we try to keep you out of court if at all possible.
However, you must prepare yourself for the idea that going to court really may be your only option. In some instances, the parties involved will try and go through the mediation process in order to come to a settlement for your case so you can stay out of court. If you cannot settle a case during mediation, you may still be required to go to court and the judge will ultimately make the final decision on the case settlement.
